1. Scope

These General Terms and Conditions of Sale (GTC) govern all purchases made on the bubukawaii.com website, operated by ALEX SMART WHOLESALE (ASWS), a single-member SARL with a capital of €500, RCS Annecy n° 108 487 091, whose registered office is located at 5 Rue de l'Industrie, 74000 Annecy, France. Any order implies unreserved acceptance of these terms and conditions.

2. Products and "Art Toys" Specifics

• 2.1 Collectible Items: The figurines and "Blind Boxes" offered are collectible items intended for an audience aged 14 and over. They are not considered toys within the meaning of CE or Swiss standards and are exclusively intended for decoration or collection.

• 2.2 Blind Boxes: Due to the random nature of the product, no exchanges or refunds are accepted for reasons of "duplicate" or dissatisfaction with the character received once the box has been opened.

3. Pricing and Transparency (Omnibus Directive)

Prices are indicated inclusive of tax in CHF (for Switzerland) or EUR (for Europe). In accordance with European regulations, any price reduction announcement indicates the lowest price charged by the seller during the 30 days preceding the application of the promotion.

4. Delivery and Customs

Thanks to our two logistics centers located in Switzerland and France, customers residing in the European Union pay no customs fees upon delivery.

• Shipping costs: Switzerland (8.50 CHF), France (7.50 EUR).

• Free delivery: Delivery is free for purchases of 34.90 CHF (or €39.90 in Eurozone countries) or more.

• Delivery times: 3 to 15 working days depending on destination and quality controls performed.

5. Right of Withdrawal and Cancellation

• 5.1 France/EU Customers: You have 14 days from receipt to withdraw (excluding opened blind boxes).

• 5.2 Swiss Customers: Mon Bubu Kawaii offers a 14-day return policy for new products with intact packaging.

• 5.3 Cancellation fees: Any cancellation request before shipment incurs administrative processing fees of 10% of the total amount, deducted from the refund. Refunds may be issued as a gift card valid for 12 months.

6. "Bubu-Coins" Loyalty Program and Promotional Games

• 6.1 Membership: Free and automatic, associated with the Customer's email address. No purchase obligation.

• 6.2 Earning points:

  • Purchases: 1 CHF/EUR spent = 1 Bubu-Coin (BC), multiplied according to the loyalty tier reached (Bronze x1, Silver x1.25, Gold x1.5, Diamond x2).

  • Birthday: 100 BC offered each year.

  • Referral: 100 BC for the referrer, 50 BC for the referred friend on their first order.

  • Product review: 25 BC per published review.

  • Mystery Box: variable points depending on the prize obtained, automatically credited to the account associated with the email address used to play.

• 6.3 Value and exchange: Bubu-Coins can be exchanged for free delivery (50 BC), 5 CHF/EUR discount (100 BC), 10 CHF/EUR discount (200 BC) or 25 CHF/EUR discount (500 BC). Discount codes resulting from an exchange are valid for 90 days. The Bubu-Coins balance is reset to zero after 12 months of account inactivity.

• 6.4 Free games (Wheel of Fortune, Mystery Box): Access to the games offered on the site is free and without obligation to purchase. Each game is limited to one participation per person (identified by their email address) and per store; any attempt at multiple participations (multiple accounts, bots, etc.) may be invalidated by the Seller. The Wheel of Fortune awards a single-use Shopify discount code, valid for 14 days from its acquisition, applicable to the entire cart except for items already on sale. The Mystery Box awards Bubu-Coins based on a weighted draw across several prize tiers.

• 6.5 The Seller reserves the right to modify, suspend, or terminate, at any time and without prior notice, the loyalty program and the games offered, without this entitling the customer to compensation, subject to the preservation of rights already acquired at the time of modification.

7. Discount Policy and Non-Combination

• Non-combination rule: Benefits cannot be combined with each other. Specifically excluded from combination are: the use of two promotional codes on the same order (including codes from the Wheel of Fortune or a Bubu-Coins exchange), the application of a code to an already discounted product, or the use of Bubu-Coins on an already discounted order.

8. Liability and Data (FADP / GDPR)

ASwS disclaims all liability for non-compliant use of collectible items. Data processing complies with the European GDPR.

9. Applicable Law and Jurisdiction

These GTC are governed by French law. The exclusive jurisdiction is set at the Commercial Court of Annecy, France.
